Hall Cottage Terms and Conditions

This Booking Agreement is a legally binding contract between the Property Owner and the Holidaymaker. The Property Owner is also referred to as “We” or “Us”. By proceeding with the Booking Agreement you accept the Terms and Conditions below, so please read them carefully. Your payment will indicate your acceptance of these terms.

A material breach of these conditions may lead to you being refused entry to the property or being asked to leave early and having your booking terminated. In such case your booking will be deemed to be cancelled and no refunds will be made.  

The Holidaymaker(s) must be over 18 years at the time of booking.

The Holidaymaker is the person who makes the online payment. This person is responsible for ensuring all members of their party using the property accept and adhere to these Terms and Conditions. The Holidaymaker is also referred to as “You’ or “Your”.

Your booking

This is confirmed when you receive written confirmation from us of your stay, by email. Please ensure the details on your booking confirmation are correct, and advise us immediately if there are any errors.

Payment

To secure your booking a booking deposit of 20% of the total cost of your holiday, is payable within 48 hours of the provisional booking being taken (unless otherwise agreed with us). The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled by us at any time without prior notice.

The balance, along with a breakage deposit of £100, is payable not less than 6 weeks prior to the start of your holiday.  Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the Holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued. 

If a booking is made less than 6 weeks prior to the arrival date, the cost of your holiday must be paid in full upon booking.

Amendments

If after you have received your booking confirmation, you wish to amend your arrangements, you should do so by contacting us at stay@hallcottage.co.uk. We will do our very best to accommodate you but cannot guarantee this will be possible. Please note that charges may apply. 

Cancellation by the holidaymaker

In the unfortunate event that you have to cancel your holiday, please advise us immediately and confirm in writing by email to stay@hallcottage.co.uk. We will confirm receipt of your cancellation request by email. 

When we confirm your cancellation in writing we will provide you with details of what (if anything) is owing to you and any deductions we have made.

Please see REFUNDS section for your entitlement to refunds.

We strongly recommend that you take out holiday insurance at the time of making the booking with cancellation cover. Whilst we allow you to cancel your stay, we cannot guarantee that we will be able to refund any part of the payments you have already made.

If you are unable to travel to Hall Cottage for any reason, or do not arrive on the day of check-in without notifying us, this will be treated as a cancellation.

REFUNDS

In the event of a cancellation, we will attempt to re-let the property. If we are successful:

You will be entitled to a refund of all payments you have made minus:

  1. any reduction in the value per night of the new booking received compared with the rate charged to you for your stay nights;

and

(b) a £50 cancellation admin charge.

If your dates cannot be resold then:

If you notified us:

More than 6 weeks prior to the check-in date

You will be charged 20% of the booking fee, minus transaction fee if applicable.

Between 3 - 6 weeks to the check-in date

You will be charged 50% of the booking fee, minus transaction fee if applicable.

Less than 3 weeks to the check-in date

You will be charged 100% of the booking fee, no refund.

Cancellation by the property owner

We would only cancel your holiday if the property was unavailable for reasons beyond our control.  In this situation, we would refund all monies paid by you for the holiday. If we had to end your holiday early, due to forces beyond our control, we will refund the appropriate proportion of the monies paid.  Our liability would not extend beyond this refund and there will be no compensation or expenses paid.

Miscellaneous

Holidaymakers must use the property for personal and domestic purposes only and not for commercial purposes.

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner's opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.

The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property.

The Holidaymaker and their party should not cause nuisance or annoyance to occupants of any property nearby.

The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.  The Holidaymaker will remain liable for the whole cost of the booking and no refund will be made.

Number of guests

The maximum number of people entitled to stay at the property is four and furthermore, only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub letting or assignation of the let is prohibited.

Arrival and Departure

Every effort will be made to have the property available from 4pm on the day of arrival. Holidaymakers are asked to check-in to the property no later than 9pm on the day of arrival.  The property must be vacated by 10:30am on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.

Pets

Pets are not permitted in the property, with the exception of assistance dogs who are welcome at no extra charge. If you have an allergy please be aware that assistant dogs may have been staying in the property at some point. The assistant dogs must not jump/sit on the settees or beds and must use their own bed.  They must not be left unattended in the property under any circumstances.  

The holidaymaker shall be liable for all damage caused by his/her assistance dog. A charge will be made for any additional cleaning required. The property owner cannot be held responsible for any accident or injury to an assistance dog during their stay. 

Hot Tubs

The hiring of Hot Tubs is not permitted under any circumstances

Breakages

The Holidaymaker and their party agree to take all reasonable and proper care of the property and the furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period, as at the beginning.  Any accidental damage or breakages should be reported to the property owner (or their representative) prior to departure. The property owner retains the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owner) will not be charged for.

The Holidaymaker’s breakage deposit, minus any deductions, will be returned within two weeks of the departure date.

Force Majeure

The property owner cannot accept responsibility for any costs or other expenses incurred as a result of any alterations, or cancellations due to unusual or unforeseeable circumstances beyond their control. This includes, but is not limited to decisions of an appropriate regulatory authority, communicable diseases, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire or adverse weather conditions.

Electrical Equipment

Guests are not permitted to bring their own electrical cooking equipment such as Air Fryers.

Fire Safety Regulations

To comply with fire safety regulations, no naked flames, candles or ethanol burners are to be used in the property.  Fireworks, Chinese lanterns or similar may not be used.

Smoking/Vaping

The property is strictly non-smoking / vaping and we ask Holidaymakers to refrain from smoking/vaping in the immediate vicinity of the property at all times.

Illegal Substances

If we, the property owners, become aware that illegal substances are being used, we retain the right to ask the holidaymakers to leave the property immediately.

Wi-Fi

Holidaymakers at the property must use the access to the internet fairly and appropriately. The property owner may monitor network performance and user usage in order to maintain a fair and high level of service to all our guests.

The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video / music / media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads / uploads. Access to illegal activity or use of our network for illegal activity is prohibited and will be reported to local authorities.

Liability

The use of the Property is entirely at the Holidaymakers’ risk and we do not accept any liability for injury, death, loss to any member of your party or any vehicles or possessions of the holiday maker or the holiday maker’s party, unless it is proven to have been caused by a negligent act by ourselves, our employees or contractors whilst acting in the course of employment. 

Complaints

Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, the property owner do recognise that from time to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.

We, the property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.  Any complaints made retrospectively cannot be considered.

Right of Entry

The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.

Children

Children under 5 years old are not permitted in the property due to safety reasons. Older children must be supervised at all times in the property and on the patio.  Under no circumstances should children be left alone in the property.

Lost property

If the holidaymaker leaves anything behind at the property the property owner will make every effort to return it to them. The holidaymaker will be asked to reimburse the cost of the postage and packing.

Parking

There is one parking space for the property to the right of the gates. Other cars can park for free on School Lane.  Vehicles are left entirely at the risk of the holidaymaker.

EV Charging

There is not an EV charging point at Hall Cottage. As there is no dedicated external sockets, charging your car from a 13 Amp socket through a window or door is not permitted at any time.

Directions

Detailed directions to the property will be provided on booking.

Data protection

Any and all personal information is collected, held and used in strict compliance with the Data Protection Regulations 2018.

Parking 

There is one parking space solely for the use of guests, at the front of the property. It is on an incline on uneven tarmac and next to a stone wall.  There is sufficient space to unload, although turning onto Over Lane can be tight.

The Driveway

The driveway to the property is shared and through a gate. Both sides of the gate can be opened to a width of 2.3m if required. 

The path to the front door is on a gentle slope with a smooth surface. The distance to the front door from the gates is 12m.

Entrance

There is a step up into the conservatory of 200mm high. The entrance is through French doors. There is a 100mm threshold,  lever handles and a 1.4m, clear opening.

Ground floor accommodation

This includes a small conservatory (with some restricted width) leading into the kitchen diner through 1060mm clear width glass doors. The living room leads off from the kitchen through a single pine door of width730mm. Stairs lead from the back of the kitchen to the first floor.

The kitchen

The appliances and storage are located on the worktop and in cupboards and shelves under and above the worktop. There is space to move around in the kitchen, although there is some restricted width between the dining table and the work top of 760mm

Living room

The living room has two sofas and a coffee table. The table can be lifted out of the way if required. There is access to the patio from the lounge through French doors. The width to the doors behind the sofa is 900mm. There is a stone fireplace and a log burner. In the living room. The fireplace has a threshold of 60mm. 

There are no facilities to sleep downstairs for people with mobility issues.

The Stairs

There are 14 stairs, with a width of 800mm. They are dog legged and as the stairs wind there is a solid wooden bannister on the left hand side followed by a solid wooden bannister on the straight flight on the right hand side and a further solid wooden bannister on the left hand side as the stairs wind at the top. The landing is 940mm wide and leads to the bedrooms and bathroom.

Bedrooms

There are two bedrooms upstairs accessed through doors of 720mm width.  The width either side of the beds in the King room is 660mm and in the Double is 550mm  There is clear space at the end of the bed of 1.9m in the King room and in the Double room 1.4m. Both sides of the beds have bedside tables and lights.

Bathroom

This room is accessed from the landing through a door with 500mm width. This is slightly restricted due to a cabinet behind the door.  It has a flush tiled floor and a bath with shower over. The bath itself is 680mm in width and has a grab handle on each side. The WC is in the corner with restricted space.

Alarms

There are smoke alarms on the landing, in both bedrooms as well as one in the living room and in the kitchen. There is a a carbon monoxide alarm in the living room and in the conservatory. These give an audible warning, but there is no visual indicator for the hard of hearing.

Patio

This can be accessed from the front entrance or from the French doors in the living room. There are lever handles, a clear 1350mm opening and two steps down from the living room, with a total height of 440mm .The patio is stone crazy paving and is uneven in parts. There is plenty of space outside the French doors, but more restricted space towards the table and chairs. At the rear of the patio there are two steps down with a total drop of 330mm

Pets

Unfortunately pets aren’t allowed, except for assistance dogs.

Public Transport

There is a regular and reliable bus service connecting Chesterfield, Bakewell and Baslow. The nearest bus stop is on the main road approximately 0.4 miles away.

Nearest shops

There is a local spar convenience store approximately 10 metres away and a Co-op store about 100m down the hill. Bakewell is 4 miles away.
